GENERAL TERMS AND CONDITIONS OF SEASONAL RENTAL ECO-LIVING AUBERVILLIERS
THE LESSOR (HOST): SAS ECO-LIVING, share capital of 10,000 EUR, RCS BOBIGNY.
Registered office: 118, avenue Victor Hugo – 93300 AUBERVILLIERS.
Property location: 2 RUE DU DOCTEUR PESQUÉ, 93300 AUBERVILLIERS.
THE TENANT (GUEST): Any natural or legal person booking and staying at the property, hereinafter referred to as "The Tenant" or "The Guest".
ARTICLE 1 - OBJECT AND LEGAL REGIME
This contract is exclusively for the rental of furnished tourist accommodation (seasonal rental). Under no circumstances may the Tenant claim any right to remain in the premises after the end of the rental period initially specified in the booking confirmation. The Lessor declares that the property does not fall within the scope of Article L. 125-5 of the Environmental Code.
ARTICLE 2 - DURATION AND ENTRY INTO THE PREMISES
The rental is concluded for the precise duration indicated at the time of booking.
● Check-in: From 4:30 PM.
● Check-out: No later than 10:00 AM.
Staying past the check-out time will result in the billing of an additional night without granting any right to remain in the premises. Administrative Formalities: In accordance with Article R. 611-42 of the Code on Entry and Residence of Foreigners, Tenants of foreign nationality must complete and sign an Individual Police Form prior to entering the premises (via the Smoobu online form or on-site).
ARTICLE 3 - PRICE AND TOURIST TAX
The price of the stay is the one validated at the time of booking. The Tenant must pay the Tourist Tax (Taxe de Séjour), which is remitted to the public establishment of Plaine Commune / City of Aubervilliers. The rate is set by municipal council deliberation in accordance with Article L 2333-30 of the CGCT. Depending on the booking platform used, this tax is either included in the total price or added separately. In the event of non-payment, a fixed penalty of 10% of the amounts due will be required, without prejudice to late payment interest and immediate termination of the contract.
ARTICLE 4 - INVENTORY AND CONDITION OF PREMISES (IMPORTANT)
Given the autonomous or digital check-in procedure:
1. A detailed inventory and status of equipment are deemed to be compliant and in "Very Good Condition" (unless explicitly stated otherwise in the accommodation).
2. The Tenant has a period of 2 hours after arrival to report any anomaly, defect, or damage to the Lessor (by email or messaging system).
3. After this period, the premises and equipment will be considered in perfect working order and cleanliness. Any damage found upon departure will be charged to the Tenant.
ARTICLE 5 - TENANT OBLIGATIONS AND HOUSE RULES
The Tenant agrees to use the premises peacefully and reasonably.
The following are STRICTLY PROHIBITED:
1. Parties and Gatherings: Zero tolerance for noise nuisances.
Any excessive noise, especially after 11:00 PM, will result in immediate termination of the lease without refund.
2. Animals: No pets or domestic animals are allowed.
3. Smoking: The entire establishment is NON-SMOKING (smoke detectors are installed). Smoking at the windows is also prohibited.
4. Overcrowding: It is forbidden to host additional people not declared in the contract.
5. Common Areas: It is forbidden to store personal items (bicycles, trash, luggage) in the common areas of the building. In the event of non-compliance with these prohibitions, the Lessor reserves the right to demand the Tenant's immediate departure (Termination Clause).
ARTICLE 6 - ACCESS AND RIGHT OF ENTRY
The Tenant must allow the Lessor or their representative to enter the premises for emergency maintenance or to verify compliance with the contract, particularly in cases of suspected noise nuisance or overcrowding.
ARTICLE 7 - LIABILITY AND INSURANCE
The Tenant is liable for all damages arising from their actions.
By accepting these conditions, the Tenant:
1. Waives all recourse against ECO-LIVING and its insurers in the event of theft, attempted theft, or criminal acts they may fall victim to within the premises.
2. Waives all recourse in the event of interruption of utility services (water, electricity, Wi-Fi) beyond the Lessor's control.
3. Acknowledges that their civil liability may be engaged in the event of an accident or damage (fire, water damage) caused by their negligence.
ARTICLE 8 - TERMINATION CLAUSE
Failure to pay the rent, or failure to comply with any of the conditions of this contract (specifically: smoking, noise, pets, occupancy limits), will result in the automatic termination of the lease (résiliation de plein droit). The Tenant must vacate the premises immediately upon simple request by the Lessor.
ARTICLE 9 - APPLICABLE LAW
This contract is subject to French law. In the event of a dispute, and failing an amicable agreement, the courts within the jurisdiction of the property's location (Bobigny) shall have sole competence.
